{"id":516,"date":"2021-09-01T16:11:27","date_gmt":"2021-09-01T20:11:27","guid":{"rendered":"https:\/\/klemalaw.com\/blog\/?p=516"},"modified":"2021-10-01T14:31:04","modified_gmt":"2021-10-01T18:31:04","slug":"upcounsel-gets-it-wrong-again","status":"publish","type":"post","link":"https:\/\/klemalaw.com\/blog\/2021\/09\/01\/upcounsel-gets-it-wrong-again\/","title":{"rendered":"UpCounsel Gets It Wrong, Again"},"content":{"rendered":"\n<p>So I finish writing <a href=\"https:\/\/klemalaw.com\/blog\/2021\/09\/01\/upcounsel-provides-false-information-on-design-patents\/\">a blog post<\/a> about blatantly false information purveyed by attorney referral service, UpCounsel (which claims it isn&#8217;t a referral service, but that&#8217;s exactly what it does), and saw, after mere seconds, more false information. <\/p>\n\n\n\n<p>This time UpCounsel says that provisional patent rights &#8220;are in force between the date of the patent application and the actual granting of the patent&#8221;<\/p>\n\n\n\n<p>Umm, nope, wrong again. In the next paragraph it provides a different statement about those same rights, this time getting it right, at least in part:<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"869\" height=\"361\" src=\"https:\/\/klemalaw.com\/blog\/wp-content\/uploads\/2021\/09\/Capture-4.jpg\" alt=\"UpCounsel website screen capture with false statement about intellectual property law. \" class=\"wp-image-517\" srcset=\"https:\/\/klemalaw.com\/blog\/wp-content\/uploads\/2021\/09\/Capture-4.jpg 869w, https:\/\/klemalaw.com\/blog\/wp-content\/uploads\/2021\/09\/Capture-4-300x125.jpg 300w, https:\/\/klemalaw.com\/blog\/wp-content\/uploads\/2021\/09\/Capture-4-768x319.jpg 768w\" sizes=\"auto, (max-width: 869px) 100vw, 869px\" \/><figcaption>UpCounsel gets it wrong, again. <\/figcaption><\/figure>\n\n\n\n<p>Provisional rights exist only upon publication of the patent AND the claims that are ultimately allowed are &#8220;substantially identical.&#8221; 35 U.S.C. \u00a7 154(d).<\/p>\n\n\n\n<p>I can&#8217;t imagine the lawyers that get clients through UpCounsel. How do they respond with the client says, &#8220;Well the UpCounsel website says _____, but you&#8217;re telling me something different.&#8221; How is their reputation as a lawyer affected when the source of the referral has information that they must then tell the client is wrong? Doesn&#8217;t that destroy the trust which is so vital to the attorney-client relationship? My goodness. <\/p>\n\n\n\n<p>All of this begs the question about why the technocrats (or lawyers and judges) can&#8217;t bring to bear technology that helps produce consensus rather than perpetuates bad or outright false information? Why can&#8217;t I, as an experienced patent attorney report to Google or DuckDuckGo that a website has false information? Why no feedback to help avoid the social ill that results from truly false information? <\/p>\n\n\n\n<p>If you want trustworthy advice, don&#8217;t rely on UpCounsel or similar SEO-referral drivel. Hire a lawyer who actually knows what they&#8217;re talking about. It will save you heartache and money. <\/p>\n\n\n\n<p>NB: The irony of the last paragraph is not lost on me.
