{"id":277,"date":"2018-01-12T14:39:14","date_gmt":"2018-01-12T18:39:14","guid":{"rendered":"https:\/\/klemalaw.com\/blog\/?p=277"},"modified":"2018-01-12T14:41:13","modified_gmt":"2018-01-12T18:41:13","slug":"no-trade-secret-for-uber-data","status":"publish","type":"post","link":"https:\/\/klemalaw.com\/blog\/2018\/01\/12\/no-trade-secret-for-uber-data\/","title":{"rendered":"No Trade Secret for Uber&#8217;s Data in Government License"},"content":{"rendered":"<h1>No Trade Secret Protection for Uber&#8217;s Rider Data<\/h1>\n<p>On January 10, 2018, the <a href=\"https:\/\/klemalaw.com\/files\/Uber-v-Broward-County-Trade-Secret.pdf\">Florida Fourth District Court of Appeals held<\/a> that rideshare company Uber (through its subsidiary Raiser LLC), <strong>could not claim trade secret protection to prevent the disclosure of its rider data.<\/strong><\/p>\n<p><a href=\"https:\/\/klemalaw.com\/blog\/wp-content\/uploads\/2018\/01\/yellow-cab-parking-lot-airport.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-282 size-medium alignleft\" src=\"https:\/\/klemalaw.com\/blog\/wp-content\/uploads\/2018\/01\/yellow-cab-parking-lot-airport-300x149.jpg\" alt=\"\" width=\"300\" height=\"149\" srcset=\"https:\/\/klemalaw.com\/blog\/wp-content\/uploads\/2018\/01\/yellow-cab-parking-lot-airport-300x149.jpg 300w, https:\/\/klemalaw.com\/blog\/wp-content\/uploads\/2018\/01\/yellow-cab-parking-lot-airport.jpg 756w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a>The case resulted from traditional taxicab company, Yellow Cab, seeking public records disclosure from the county. (Yellow Cab in South Florida operates as B&amp;L Service, Inc.) The county initially refused to disclose the requested information to Yellow Cab because its <a href=\"https:\/\/klemalaw.com\/files\/Uber-License-Agreement-airport-government.pdf\">license agreement<\/a> with Uber required the county to keep certain information provided by Uber to the county confidential. The information that Uber was required to provide to the county, and which the county agreed to keep confidential included:<a href=\"https:\/\/klemalaw.com\/blog\/wp-content\/uploads\/2018\/01\/uber-logo.png\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-284 alignright\" src=\"https:\/\/klemalaw.com\/blog\/wp-content\/uploads\/2018\/01\/uber-logo.png\" alt=\"Uber logo\" width=\"200\" height=\"200\" srcset=\"https:\/\/klemalaw.com\/blog\/wp-content\/uploads\/2018\/01\/uber-logo.png 300w, https:\/\/klemalaw.com\/blog\/wp-content\/uploads\/2018\/01\/uber-logo-150x150.png 150w\" sizes=\"auto, (max-width: 200px) 100vw, 200px\" \/><\/a><\/p>\n<ol>\n<li>number of pickups and drop offs;<\/li>\n<li>date and time;<\/li>\n<li>GPS coordinates; and<\/li>\n<li>license plate (partial).<\/li>\n<\/ol>\n<p>Initially, the trial court concluded that all of the Uber data was \u201cprotected trade secrets and exempt from disclosure under Florida\u2019s Public Records Act.\u201d<\/p>\n<p>However, after Yellow Cab sought rehearing on its motion to compel disclosure of the records from the county, Judge Sandra Perlman receded from her initial decision and held that the <em>aggregate<\/em> data\u2014the number of pickups and amount of money paid by Uber to the county\u2014was not protectable as a trade secret. Uber then appealed.<\/p>\n<p>The Fourth DCA agreed that \u201cthe total number of pickups and the fees paid . . . do not meet the definition of trade secrets under\u201d Florida\u2019s trade secret statute, 688.002(4), and therefore Uber had no right to prevent the county from disclosing it under Florida&#8217;s strong public records disclosure law (called the &#8220;sunshine law,&#8221; go figure). It further agreed that the information did not \u201cprovide an advantage to Yellow Cab or that Uber derives independent economic value from keeping that information secret.\u201d<\/p>\n<p>It further relied on other Florida cases finding that \u201csales volume, income statements, and gross sales of a corporation are not trade secrets\u201d and also cited to a similar federal case involving another rideshare company, Lyft, and concluded that \u201crevenue is not strategy but rather the result of that strategy.\u201d <span style=\"text-decoration: underline;\">Cotter v. Lyft, Inc.<\/span>, No. 13-cv-04065-VC, 2016 WL 3654454, at *2 (N.D. Cal. June 23, 2016).<\/p>\n<p>The appellate case is <a href=\"https:\/\/klemalaw.com\/files\/Uber-v-Broward-County-Trade-Secret.pdf\"><span style=\"text-decoration: underline;\">Raiser-DC, LLC v. B&amp;L Serv., Inc.<\/span>, __ So. 3d __ , no. 4D16-3070.
